Ruto Criticizes Judiciary Over ''Kenyan Innovation’' in Graft Cases

President William Ruto has once again taken aim at the Judiciary for granting anticipatory bail to corruption suspects, saying the practice is derailing the country’s anti-graft campaign.

Addressing delegates at the Devolution Conference in Homa Bay on Wednesday, August 13, 2025, Ruto described anticipatory bail as a “Kenyan innovation” that shields suspects from arrest and prosecution before they have even been charged.

According to the President, such rulings provide a safe haven for individuals facing corruption investigations and make it harder for state agencies to build solid cases against them.

“We cannot have a Judiciary that becomes a refuge for corrupt individuals hiding behind judicial decisions. These practices undermine our collective fight against corruption,” Ruto said.

The Head of State reiterated remarks he made during his State of the Nation Address on November 21, 2024, where he called on the Judiciary to reconsider its stance on anticipatory bail and align its decisions with the country’s broader goal of eradicating graft.

Ruto also challenged the Director of Public Prosecutions (DPP) and the Ethics and Anti-Corruption Commission (EACC) to move with greater urgency in prosecuting corruption cases. He contrasted their slow pace with the Judiciary’s rapid handling of election petitions, saying Kenyans expect the same speed in cases involving theft of public resources.

“We cannot have corruption cases dragging on for years while suspects continue to enjoy the proceeds of their crimes,” Ruto said, urging coordinated action between the Judiciary and investigative agencies.

The President’s remarks come amid ongoing debate over judicial independence, the rule of law, and the balance between protecting individual rights and fighting corruption.
